Allegation(s)
Allegation 1: GF failed to act in the best interests of a client and failed to maintain high standards of professional and personal conduct by stating that a legal notice had been served on a leaseholder when it had not, thereby breaching Principle 2 and Principle 5 of the CILEx Code of Conduct 2010.
Allegation 2: GF did not behave with honesty and integrity and misled a client by informing them that an application had been issued at court when it had not, thereby breaching Principle 3 of the CILEx Code of Conduct 2010.
Allegation 3: GF failed to act in the best interests of a client and failed to maintain high standards of professional and personal conduct by informing a client that an application had been issued at court when it had not, thereby breaching Principle 2 and Principle 5 of the CILEx Code of Conduct 2010.
Outcome
GF admitted the misconduct and a Determination by Consent was agreed between CILEx Regulation and GF.
Sanction
GF was reprimanded and agreed to give four undertakings.
1. GF undertook to submit a supervision schedule within seven days of the Determination by Consent Order;
2. GF undertook to be supervised for three years;
3. GF undertook to complete continuing professional development in management training by 30 November 2015; and
4. GF undertook to pay any outstanding balance of CILEx subscription no later than 4 December 2015.
