Allegations
Allegation 1: SW, has in error, held himself out to be a Solicitor in a letter dated 18 December 2013 to a client, thereby breaching Principle 9 of the CILEx Code of Conduct 2010.

Allegation 2: Between December 2013 and October 2014 SW, failed to act in the best interests of his client on a number of occasions thereby breaching Principle 5 of the CILEx Code of Conduct 2010.

Allegation 3: On various dates between December 2013 and October 2014 SW failed to advise his client and/or act upon his clients instructions, thereby breaching Principle 3 of the CILEx Code of Conduct 2010.

Outcome
SW admitted the misconduct and a Determination by Consent was agreed between CILEx Regulation and SW.

Sanction
SW agreed to give three undertakings.

i. SW undertook to complete Continuing Professional Development (CPD) in case and time management to be approved by CILEx Regulation by the end of the current CPD year which is 30 September 2016.

ii. SW undertook to log his CPD under the new CPD scheme and to be subject to compulsory sampling of the CPD.

iii. SW undertook to provide details of the CPD undertaken in case and time management, as well as the CPD documentation which shows how the course met his intended outcomes to the CILEx Regulation Investigation Manager no later than the end of the CPD year, which is 30 September 2016.
