Charges
The charges brought against Miss Tracey Robins are:

Charge 1
Failing to uphold the rule of law and the impartial administration of justice, contrary to Principle 1 of the IPS Code of Conduct for CILEx members.

The particulars were that on 28 June 2013 Tracey Robins, a Fellow of CILEx, was upon her own confession:

(i) Convicted in the Crown Court at Maidstone of two counts of Fraud contrary to section 1 of the Fraud Act 2006.

(ii) Convicted in the Crown Court at Maidstone of two counts of Theft contrary to section 1(1) of the Theft Act 1968.

Charge 2
Failing to maintain high standards of professional and personal conduct, contrary to Principle 2 of the Code of Conduct for CILEx members.

The particulars were that on 30 May 2013 in consequence of her said misconduct the Solicitors Regulation Authority Adjudicator made an order pursuant to Section 43 of the Solicitors Act 1974 against Tracey Robins that with effect from such date except in accordance with Law Society permission:

(i) No solicitor shall employ or remunerate [Tracey Robins], in connection with his practice as a solicitor;

(ii) No employee of a solicitor shall employ or remunerate [Tracey Robins], in accordance with the solicitor’s practice;

(iii) No recognised body shall employ or remunerate [Tracey Robins];

(iv) No manager or employee of a recognised body shall employ or remunerate [Tracey Robins] in connection with the business of that body;

(v) No recognised body or manager or employee of such a body shall, except in accordance with a Society permission, permit [Tracey Robins]to be a manager of the body;

(vi) No recognised body or manager or employee of such a body shall, except in accordance with a Society permission, permit [Tracey Robins] to have an interest in the body.

(vii) On 3 June 2013 the Adjudicator further ordered pursuant to the SRA (Costs of Investigation) Regulations 2011 that the said Tracey Robins do pay a charge to the Solicitors Regulation Authority of £600 in connection with its investigation of conduct allegations.

Charge 3
Failing to behave with honesty and integrity and/or act within your competence, contrary to Principle 3 and/or Principle 9 (and/or the obligation to comply with other Codes) of the Code of Conduct for CILEx members .

The particulars were that on and/or between 3 March 2008 and 3 April 2012 Tracey Robins provided a copy of her CV to FP LLP solicitors which contained a misrepresentation of her qualifications namely:

(i) “Qualified as a Legal Executive F.Inst.L.Ex-2002”, which was a false statement as she qualified as a Fellow of the Institute of Legal Executives in November 2004, now the Chartered Institute of Legal Executives.

(ii) In or around 2012 Tracey Robins provided a copy of her CV to RG which contained a misrepresentation of her qualifications, namely: “Qualified as a Legal Executive F.Inst.L.Ex-2002”, which was a false statement as she qualified as a Fellow of the Institute of Legal Executives in November 2004, now the Chartered Institute of Legal Executives.

Outcome
All charges were found proven.

Sanction
The Disciplinary Tribunal ordered Miss Robins be excluded from membership for an indefinite period.
